What Skills are required?

The ability to manage multiple projects with various priorities, Excellent written and oral communication skills, Proven Interpersonal and problem solving ability, The ability to deliver projects in a timely manner, Experience in Multimedia/Graphic Design is vital, Knowledge in Flash, HTML and Photoshop design and development, Skills in website design & development, including CSS, JavaScript and PHP, The ability to discuss & clearly portray your ideas, Knowledge of FTP and Domains, Experienced in Dreamweaver, Microsoft Office and fireworks, A clear understanding of Project Management Procedures, A tertiary qualification that includes project management in at least one module

How can I meet these requirements?

Studying a cert 4 in web design will tick off most of these boxes because the listed skills are skills I will learn within this course. To further my skills I could enroll in the Diploma course once I have finished. Opera’s Website http://www.opera.com has an online course that I could do to further my knowledge and skills, This site can help me with the coding such as HTML, CSS and JavaScript. And to find out more about Flash, and Fireworks, Adobe have online video tutorials on how to use their programs. Basically the time it would take to obtain a good understanding in these areas from start to finish is around 2 years. By this time I should have a knowledge of Web Development at a standard I am happy with, and I would be able to find a good job (hopefully).

What to do when there is unauthorised use of your material

If you find that your copyright material has been stolen there are several things that you need to do in order to ensure that whoever was using your work removes it from their site (or whatever form of copyright they have breached), or that they get permission to keep the use of your material by contract, and or pay you royalties for the privellage.

Firstly you want to identify the core of the stolen copyright material, then you can request immediate removal of the material, if it is placed on the internet you can even request that their site be removed from search engines. If they do not meet your requests and remove your material you have full right to take legal action, allthough this can be a slow and costly process of getting things done. Usually an ideal outcome would be to get the stolen content removed immediately and a sincere apology. It is entirely up to you as copyright holder to in which demands the thief must meet. i.e. You are entily in your own right to request a backpayment for the time in which your material was used without permission.

All in all stopping your work being stolen in one form or another is a very hard task indeed, and will become increasingly difficult to moniter in the future with the ever expanding web.

What is not copyright protected

Today im going to ramble on about what is not copyright. Ideas, concepts, and principals are all excluded from copyright protection. If these were not then the person who first wrote a song of any particular genre could claim that any future song of the same genre was infringing his copyright. No one can copyright an idea or genre, however the original words that make up the work are protected. Copyright protection for a work doesn’t extend to pre-existing material. It is only provided for those portions of a work that came from it’s original form. For example A director might want to use a song he likes in his film , he must then find out if the song is still under copyright protection, which it probly will be. From here he could then contact the owner of copyright and ask permission to use the song, If the director then gets permission to use the song, the copyright on his film would not cover the portion that he has borrowed. Any copyrights for pre-existing material used for other works remain with the original author, unless the two parties enter into an agreement or contract.

What is rights Management

Rights managment is the stored information on the site, documenting various things including owner or any specific copyright clearance conditions. The rights owner may also have specific guidlines of what material and information will be on the site. You may be required to store the information in a particular format. This may also include converting rights management information into material on the site so that later uses of the chosen material can be tracked. A rights owner may also request as one of the clearance conditions that you report activity . Some people create a system that automates this process.

Get Consent to publish Copyright Material.

Recently i saw a great photo of a group of clouds that was in the shape of a white dove. i think the photoo would look great on my website, however i do not hold copyright for the phot. So i am going to take the necessary steps in order to hopefully be able to gain permission for the use of the photo.

Below is a simple letter i created and sent to the copyright owner of the photo26 August 2009

Dear Jake

My name is Louis Stone,

I’m a web developer from Australia and recently came across your unique photo of the clouds in the formation of a white bird. The link below will take you to the photo I’m enquiring about.

Unfortunately I am not able to pay you for use of this photo, but I will be sure to have a credit of your name with the photo.

When creating new material what must you do to protect your copyright?

In Australia copyrighting your work is quite simple, to obtain copyright of your own work all you have to do is record the work in a tangible form, be it written, printed or recorded etc. If you have taken a photo for example it is automatically copyrighted to you because the photo itself is the tangible form.

However in America it’s a different story, to obtain copyright you must physically register your work. aka pay money to get copyright.

Create and publish original material

The top is a photo that i took at the beach in front of my place on a late summer afternoon, blah blah blah blah.

I have found that someone else has used one of my own photos own their blog, i have contacted the culperet and told him to remove the picture

Who do you need a clearance from???

You will need a clearance from the owner of the copyright, for example say you want to play music on your company phones hold tone. In order to do this you will need to go to the company that employs the singer or band and request a copyright clearance, You might think that the singer holds copyright but it is infact the big wig record companies who basically own the singers and bands, and most of their works money. An example of this was when Michael Jackson bought the rights to all current and future Beatles royalties, they were able to do this because the Beatles band members themselves did not own their music, the record label did and as you can see they are free to with it what they please. Fat load of good it did michael Jackson though cos he dead. So if you wanted a Beatles song for your movie, you would probly end up putting money in Michael Jacksons pocket, not Paul and Ringo.

There are many issues to consider when putting together a copyright clearance, some of those that definately should be taken into consideration are : The length of time the copyright agreement is for, permission to reproduce and if so in what volume, multiple licensing rights, the number of times it may be used, or wether or not a one time licensing agreement is more suited, You might be after world rights if you intend on producing the content world wide and through differant languages. Exclusive rights where you retain the sole right to that material and even similar material in some instances and language rights which defines what languages are permitted to be used in relation to the work.

Of course the more you dive into the subject of copyright the more you will find, and if you want to cover absolutely all bases you will definately have to do your homework as the technical side of copyright is almost endless.

When do we need copyright clearance

You will need a copyright clearance if you are working on something that draws or is based on events, (or the life) of somebody else. For example if you were to be shooting a film that is simmilar or based on someone elses work or book that is still protected by copyright. Implications that can easily result in legal battles include obligations relating to misrepresentation of facts, ie defamation, and legal obligations relating to confidential information

Copyright of a book , for example a novel includes the sole right to adapt that work, be it converting it into a script for the big screen, allthough in this situation you will probly need to get an “option” which is an agreement with the publisher or writer

You will almost always need copyright for your work in any of these fields, the exceptions being if the original works copyright has expired, or unique exceptions such as for example Australian law allows the inclusion of an artistic work in a movie if it is “incidental”.
